Due Process Hearings Under the IDEA

Apr 18, 2021 | Dispute Resolution, Procedural Safeguards

A due process hearing is one way to resolve disputes under the Individuals with Disabilities Education Act (IDEA). Each state sets its own procedures, consistent with the requirements of the IDEA.

Due process hearings in Virginia are typically private, held around a conference table with just the participants in attendance. So most parents are not able to get insight into what a due process hearing entails. But parents can invite others to watch their due process hearing, or they can share the transcript if they choose. A parent in Fairfax County put an entire six day due process transcript online so other parents can learn from it.
