Parents in Virginia Now Have Right to IEP Draft Before the IEP Meeting

Virginia has added a new parent right to its Special Education Regulations: “If the local educational agency [LEA = school district] elects to use a draft version of an IEP in any IEP team meeting, such draft shall be developed and a copy shall be provided to the parent at least two business days in advance of the IEP meeting.”

This regulation does not require school divisions to develop a draft IEP prior to a meeting. But if schools elect to develop a pre-meeting draft (a common practice), they are now required to provide the draft to parents two business days before the meeting.
